Terms and Conditions of Sale

Article 1 — Purpose

These Terms and Conditions govern the contractual relationship between Boulangerie Sports Collectibles ("BSC Breaks") and any individual ("the Customer") making a purchase on bscbreaks.com. Any purchase implies full acceptance of these Terms and Conditions.

Article 3 — Products and Services

BSC Breaks offers the following services: • NBA Breaks: collective openings of NBA card boxes streamed live on Twitch and YouTube. The Customer purchases one or more spots (team, player or numbered slot) before the live. The corresponding cards are then shipped to them. • Personal Opening: the Customer purchases an NBA card box that BSC Breaks opens live. All cards belong to the Customer. • BSC Marketplace: a platform for selling individual NBA cards. Two types of cards available: BSC stock cards (direct sale) and consignment cards (cards owned by customers and entrusted to BSC Breaks for sale). For consignment cards, a commission is deducted from the sale price; the seller receives the net amount as BSC Credit. Available formats: Pick Your Team (PYT), Random, TierBreak, Pick Your Player (PYP) and Personal Opening.

Article 4 — Prices

All prices are shown in euros including tax. BSC Breaks reserves the right to change prices at any time; the applicable price is the one in effect at the time of ordering. Shipping costs are calculated and displayed when the Customer submits their shipping request from their personal account, after the live session.

Article 5 — Order and Reservation

A spot reservation is valid for 5 minutes. After this period, the spot is automatically relisted if payment has not been completed. The order is confirmed once payment is validated by Stripe. A confirmation email is sent to the Customer.

Article 6 — Payment

Payments are processed online via Stripe, a secure payment platform. BSC Breaks does not store any banking data. BSC Credit: BSC Breaks offers an internal credit system called "BSC Credit". This credit can be earned from the sale of a consignment card on the BSC Marketplace. It can be used to reduce the total amount of any purchase on the site (breaks, marketplace). BSC Credit is non-refundable, cannot be exchanged for cash, and is non-transferable to another account. An expiry date may be applied to the credit at the time of attribution.

Article 7 — Delivery

After the live session, cards won by the Customer are kept by BSC Breaks until the Customer submits a shipping request from their personal account on bscbreaks.com. There is no time limit for making this request. Once the request has been submitted, BSC Breaks prepares and ships the package as soon as possible. The Customer receives an email with the tracking number as soon as it is dispatched. Available carriers are Mondial Relay and UPS. An in-person pick-up option is also available (📍 Nogent-sur-Marne). Shipping costs vary depending on the destination country, chosen carrier and package weight. They are displayed at the time of the shipping request. BSC Breaks ships from France to European countries and the United Kingdom. Sample shipping rates (standard parcel): • France: from €5 (Mondial Relay) or €14 (UPS) • Belgium: from €13 (Mondial Relay) or €22 (UPS) • Germany: from €13 (Mondial Relay) or €22 (UPS) • Spain: from €7.10 (Mondial Relay) or €22 (UPS) • Italy: from €7.10 (Mondial Relay) or €22 (UPS) • Netherlands: from €5.10 (Mondial Relay) or €22 (UPS) Full rates are calculated automatically when you submit your shipping request, based on your parcel size and delivery country.

Article 8 — Right of Withdrawal

In accordance with article L221-28 of the French Consumer Code, the right of withdrawal does not apply to goods whose contents have been revealed during a live stream. Purchased spots are therefore non-refundable except in the event of cancellation of the break by BSC Breaks.

Article 9 — Cancellation by BSC Breaks

If a break is cancelled by BSC Breaks, the Customer will be fully refunded via Stripe within 5 to 10 business days. A confirmation email is sent automatically.

Article 10 — Claims

Article 11 — Applicable Law

These Terms and Conditions are governed by French law. In the event of a dispute, the courts of Paris shall have jurisdiction.

Article 11 bis — Mediation

In accordance with French consumer law, BSC Breaks offers a consumer mediation system. In the event of an unresolved dispute, the Customer may contact the following mediator free of charge: CNPM - Médiation de la Consommation — https://www.cnpm-mediation-consommation.eu

Article 12 — Auctions

BSC Breaks offers an auction system for certain PYT break spots and certain BSC Marketplace cards. 12.1 — Binding purchase commitment Any winning bid constitutes a firm and irrevocable purchase commitment by the Customer. Winning an auction automatically creates a binding obligation to complete the corresponding payment. 12.2 — Payment deadline The Customer has seventy-two (72) hours from the close of the auction to complete payment. During this period, the winning card or team is reserved under their name in their shopping cart. 12.3 — Non-payment Upon expiry of the seventy-two (72) hour period, if no payment has been made, the reservation is automatically cancelled and the item is relisted or made available again. BSC Breaks reserves the right to sanction repeat non-payment, including by suspending the account. 12.4 — No withdrawal In accordance with article L221-28 of the French Consumer Code and the competitive nature of auction sales, the winning item cannot be removed from the cart while the payment period is in progress.
